Terms of Service

By using our website or app, or by placing an order, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use our services.

You must be at least 18, or the age of majority where you live, and able to enter a binding contract. If you use our services for an organization, you confirm you can bind it to these Terms.

• You can browse and add to your bag without an account. Signing in lets you follow orders and manage your details.
• Keep your password confidential. You are responsible for what happens under your account, and you should tell us straight away if you think someone else has used it.
• Keep your details accurate and up to date.
• You can delete your account at any time in the app (Account, then Delete account), on our account deletion page, or by emailing us. Deletion is permanent. Orders you have already placed will still be fulfilled.
• We may suspend or close accounts involved in fraud or serious breaches of these Terms.

• We work hard to show products accurately, but colors vary between screens and small differences between the photo and the finished piece can happen with printed goods.
• Placing an order is an offer to buy. We may decline or cancel an order, for example if a product is unavailable, a price is clearly wrong, or we suspect fraud. If we cancel after you have paid, we refund you in full.
• You can cancel an order within 12 hours of placing it, before production starts, by emailing us. After that it has gone into production and can't be cancelled.
• Most pieces are made to order, which takes 2 to 7 business days before shipping. See Shipping for delivery estimates.

• Prices are in US dollars unless shown otherwise, and shipping is already included. We may change prices, but not for an order you have already placed.
• Payment is taken when you order and is processed securely by Stripe. We accept major cards and the other methods Stripe offers at checkout.
• Sales tax, where it applies, is shown at checkout. Customs duties and import taxes on international orders are not included and are paid by you.

• Delivery times are estimates, not guarantees.
• Please check your shipping address. If a parcel comes back because the address was wrong, re-shipping costs are yours.

We accept returns within 30 days of delivery for items that arrive damaged, defective or wrong, and we will replace or refund them. Because our pieces are made to order, we can't accept returns for change of mind or a wrong size or color choice. The full policy is on our Returns & Refunds page. If you live in the EU or UK, you may have additional rights, described in section 14.

Our style assistant and chat use artificial intelligence to suggest products and answer questions. Their answers can be wrong or incomplete, so please check a product's page before you buy. Don't enter sensitive personal information. What you type is processed as described in our Privacy Policy.

Our designs, logos, text, photos and software belong to OTESC or its licensors and are protected by copyright and trademark law. You may view and print pages for your own personal, non-commercial use. You may not copy, sell or reuse our designs or content, use our trademarks, or scrape or mirror our website or app without our written permission.

You agree not to:

• use our services for anything illegal or fraudulent;
• impersonate anyone or give false information;
• interfere with, overload or try to break into our systems;
• upload malware or harmful code;
• collect other people's information without their consent;
• use automated tools to access our services, other than search engines indexing our public pages.

Our services are provided "as is" and "as available". To the extent the law allows, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement.

To the extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits or data, and our total liability for any claim is limited to the amount you paid us in the six months before the claim.

Nothing in these Terms limits liability that cannot legally be limited, such as liability for fraud, or for death or personal injury caused by negligence, or your statutory rights as a consumer.

To the extent the law allows, you agree to indemnify OTESC against claims and costs, including reasonable legal fees, arising from your breach of these Terms or your misuse of our services.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict of law rules.

Before starting any claim, please email us so we can try to resolve it; most problems are sorted out quickly. If we can't resolve it within 30 days, any dispute will be settled by binding individual arbitration in San Francisco, California. You and we each waive the right to a jury trial and to take part in a class action or class-wide arbitration. Either of us may still bring an individual claim in small claims court.

If you are a consumer living in the European Union, the European Economic Area or the United Kingdom:

• You keep the protection of the mandatory consumer laws of the country where you live, whatever section 13 says.
• The arbitration clause and class action waiver in section 13 do not apply to you where your local law does not allow them, and you may bring proceedings in the courts of the country where you live.
• Where the law gives you a right to cancel a distance purchase within 14 days, you can use it by emailing us within 14 days of receiving your order. Some goods made to your specifications or clearly personalised are excluded from this right by law.
• You have a legal right to goods that are as described, of satisfactory quality and fit for purpose. Our returns policy is in addition to, not instead of, that right.
• The European Commission's online dispute resolution platform has closed. You can still contact your national consumer body for help.

• We may update these Terms. The date at the top shows the latest version, and we will tell account holders about significant changes by email. The Terms in force when you placed an order apply to that order.
• If any part of these Terms is found unenforceable, the rest still applies.
• If we don't enforce a right straight away, we haven't given it up.
• These Terms, with the policies they link to, are the whole agreement between you and us about our services.
